Privacy and Online Use Policies (revision 3/10/22)

The purpose of Ada County Medical Society (ACMS) is to advance the well-being of its members through the promotion of health, education, community, and civic engagement. The Society collaborates with similar organizations throughout Idaho to form the Idaho Medical Association, Inc. (the “IMA”). We have developed the following policies around the privacy of members and others who engage with ACMS.

1. Statement of Privacy

Ada County Medical Society, Inc. (ACMS) is committed to protecting your privacy while providing services, programs, and technology that balances the needs and desires of our members with necessary business operations. This Statement of Privacy applies broadly to all interactions with ACMS, including the use of websites we manage and publish, events, directories, and communications, and data we collect about you and how it is used. For purposes of simplicity, all users of our websites or other businesses or individuals who interact with ACMS will be referred to as “members” in this document, unless designated “qualified members.”

Collection and Use of your Personal Information

As a necessary part of being a "qualified member” or registering in any way with our organization, ACMS collects personally identifiable information, such as your e-mail address, name, home or work address, or telephone number, specialty, practice name, certifications, education, and so on. Some information is collected through paper or online forms you may fill; some of it may be collected from or provided by other sources, such as central verification offices or your employer, and some may be collected from other publicly available sources.

Use of Publicly Available Information

We are a membership-driven organization and as such, unless otherwise specifically requested, “qualified membership” is in the public domain. ACMS uses all generally available public information about your medical practice (company, specialty, education, certifications, etc.) and may publish it in our online “qualified member” directory and/or in a printed directory. You may opt-out of being listed in our public directory, our “qualified member” directory, or out of ACMS “qualified membership” altogether by writing the Executive Director at the address below.

The ACMS Board of Directors must approve any requests from business partners who may wish to have an electronic copy of the publicly available information of the “qualified member” database. The Board uses great discretion in doing so.

Use of Not Publicly Available Information

Information that is not generally known (such as your home address, cell phone number, email, birth date, spouse's name, etc.) is not published or made known to others aside from ACMS business operations unless you designate them as your primary point of contact for your practice.

ACMS may also use your contact information to directly inform you of other products or services available from ACMS and/or its business affiliates. ACMS may also conduct surveys about your opinion of current services or of potential new services that may be offered.

Private information which is not available to the public is not provided to business partners, except, for example, when a registered attendance list is provided to event sponsors/exhibitors.

ACMS may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to ACMS, and they are required to maintain the confidentiality of your information.

Information Collected via Web Sites or Apps

As a standard business practice in managing our website(s) or social media accounts, ACMS also may collect anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests, etc. Other information about your computer hardware and software may be automatically collected by ACMS using Google Analytics or similar means. This information can include your IP address, browser type, domain names, access times, and referring Web site addresses. This information may be used by ACMS to provide general statistics regarding the use of such sites.

ACMS encourages you to review the privacy statements of Web sites we choose to link to and social media or app platforms we choose to use so that you can understand how they collect, use, and share your information. ACMS is not responsible for the privacy statements or other content on Web sites or apps

Use of Cookies

ACMS websites use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a Web page server. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer or clear them. If you choose to decline cookies, you may not be able to fully experience the interactive features of the ACMS services or Web sites you visit.

Security of your Personal Information

We strive to protect control of our website, within the constraints of resources and current Internet technology. However, you must be aware that third parties may obtain unauthorized access to our sites or ACMS databases and gain access to information about you that is not publicly available.

ACMS secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. When personal information (such as a credit card number) is transmitted to other Web sites, it is protected using encryption, such as the Secure Socket Layer (SSL) protocol.

You are responsible for your activities and conduct while on our sites and for the use of any information obtained from our sites. You agree that Ada County Medical Society, Boise, ID, and its affiliated entities, agents, employees, directors, and contractors cannot be held liable for damages, costs, or expenses (including attorney’s fees) that you may have due to your violation of these Terms of Service, your activities in connection with our site, or any unauthorized access by third parties.

Member Privacy

ACMS “qualified members” and/or affiliated businesses or individuals may choose to expose more of their contact details to other members through the online membership platform of adamedicalsociety.org via the MemberClicks company. (On this website, all such individuals are collectively known as “members.”) It is the responsibility of members to review their profile and contact information for accuracy as well as its visibility to others.

All board and staff members and some volunteers may have access to membership lists, including “qualified member” status, and must take care to comply with our privacy policy and all sign confidentiality agreements.

“Qualified members” may choose to not be listed in online directories made available to the public or to other members. They may also choose to opt-out of all email and/or snail mail communications other than what is required by the ACMS by-laws.

Because membership with ACMS is unified with the Idaho Medical Association, we work to keep our “qualified member” lists in sync with each other. You may choose to use a different email address or other contact information with each organization, as well as maintain different visibility within the qualified membership. However, it is a member’s responsibility to communicate with each organization separately about such preferences and neither ACMS nor IMA is required to communicate your preferences with the other.

Use of Photographic, Video and/or Audio Recordings

Photographs and/or videos with or without audio are often taken at ACMS member events, whether visible to the public or otherwise. By attending ACMS events you grant ACMS full rights to use the images (including yourself, your family members, and/or any other guests you might bring with you) resulting from the photography/video filming, and any reproductions or adaptations of the images for fundraising, publicity, or other purposes to help achieve organizational aims. This might include (but is not limited to), the right to use them in our printed and online publicity, social media, press releases, and funding applications.

ACMS will use discretion with use of photos/recordings of individual minors taken at such events, except when such minors are part of a larger crowd.

Disclosure of Information When Required

ACMS will not disclose your personal information other than as stated above, without notice, unless if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on ACMS or the site; (b) protect and defend the rights or property of ACMS; (c) act under exigent circumstances to protect the personal safety of users of ACMS, or the public; or (d) for other reasons stated on this page.

2. Acceptable Use of Website Policy

Accuracy not Guaranteed

Every effort is made to ensure that published information about our "qualified members” provided is correct, but do not guarantee that all information is accurate and/or up to date.

No Implied Warranty or Merchantability

Our sites are provided as a service for the members and affiliates of Ada County Medical Society (ACMS) and in some cases, to the public. ACMS is not responsible for the opinions and information posted on our sites by others. We disclaim all warranties about information posted on our sites, whether posted by ACMS or any third party; this disclaimer includes all implied warranties of merchantability and fitness.

Health-Related Information is Educational Only

ACMS may provide health-related information on our sites for educational purposes only. The information provided through our sites should not be used to diagnose or treat a health problem or a disease, and it is not a substitute for professional medical care. If you have or suspect you may have a health problem, you should consult a doctor or other health care provider. The health information provided on our sites adds to and does not replace the relationship that exists between you and your physician or other health care provider. 

In no event shall ACMS be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use or performance of any information posted on our sites.

Referrals and Advertisers

ACMS may include advertisements from or referrals to businesses that have purchased space, sponsored events, or provided other remuneration to ACMS. While their appearance in the directory does not constitute an endorsement, your consideration of their products and services is appreciated.

Changes to this Statement

ACMS may occasionally update this Statement of Privacy and Acceptable Use of the Website Policy to reflect company and customer feedback. ACMS encourages you to periodically review these Statements.
